WHS Act 2011 and WHS Regulation 2011
In Canberra and the ACT, workplaces are required to meet compliance regulations under the Work Health & Safety Act 2011 and the Work Health and Safety Regulation 2011.
The Work Health and Safety ACT 2011 outlines the legal obligations and responsibilities for the PCBU (persons conducting business or undertaking). The Work Health and Safety Regulation 2011 provides further detail in complement to the WHS Act 2011, setting out the legal obligations for the workplace, with specific areas or hazards in the workplace.
Under Work Health Safety Regulations 2011, Regulation 43, it is legally binding that a PCBU shall have an Emergency plan that provides outline of the following:
Emergency procedures
Effective response to an emergency
Evacuation procedures
Notifying Emergency Services
Medical treatment and assistance and effective communication
Testing the procedures and information
Training and instruction to the workers to implement the procedures
Australian Standard 3745
The main Australian Standard for managing emergencies is the Australian Standard 3745 Planning for Emergencies in Facilities (AS3745).
AS3745 sets the minimum standard and technical guidance for managing emergencies at a facility. It outlines in detail the minimum requirements for establishing an Emergency Plan, which should include:
